HOA Matters
HOA is an abbreviation for Homeowners Association, which is an organization in a subdivision, planned community, or condominium building that makes and enforces rules for the properties and its residents. The main function of an HOA is to create and enforce rules regarding the properties within the jurisdiction.
Typically, a homeowners association has a board of directions that are elected to enforce the rules and regulations set forth by the HOA. The HOA will include all rules and regulations in a document called a Declaration of Covenants, Conditions and Restrictions, or CC&Rs. This document lays out different specific conditions for owners about the maintenance of their properties. This document will also outline other penalties for violating any of the guidelines. These penalties can range from fines to forced compliance or even litigation.
There are times when a policy that a Homeowners Association mandates has gray areas, making it difficult to interpret and follow.
